Attorney General Mulilo Kabeshi has asked the Constitutional Court to drop President Hakainde Hichilema from a petition that accuses the head of state of breaching the Constitution by pushing a constitutional amendment without broad public consultation.
The case was filed by PF Mporokoso MP Brian Mundubile and Tonse Alliance Youth chair Celestine Mukandila, who want the court to bar Hichilema from future presidential nominations.
Kabeshi argues that the alleged actions were taken in Hichilema’s official capacity, making the Attorney General the proper respondent under Article 98(1) of the Constitution, which shields a sitting president from civil suits for official acts.
He cites the 2021 Supreme Court ruling in the Edgar Lungu‑Chapter One case to reinforce presidential immunity and says the court should redirect any proceedings to the Attorney General as the government’s chief legal adviser.
